Book excerpt: Excerpt from The Central Law Journal, Vol. 67: July-December 1908 The Illinois court holds that the police power does not extend so far as to prohibit the use of the national flag for advertising purposes. Justice Magruder, in the course of the decision, says: It is difficult to see how the flag law of 1899 tends in any way to promote the safety, welfare or com fort of society. The use of a likeness of the flag upon a label or as a part of the trade mark of a business man in the lawful pros ecution of his business cannot be regarded otherwise than as an act which is harmless in itself. It may violate the ideas which some people have of sentiment and taste, but the propriety of an act considered merely from the standpoint of sentiment and taste, is a matter about which men of equal honesty and patriotism may differ.
