Book excerpt: Case files include all documents generated during the course of a supreme court trial, and may be extensive, minimal or nonexistent for any given case. They may include writs, affidavits, depositions, subpoenas, verdicts, pleas, motions, warrants, bonds, bills of costs, witness certificates, transcripts, findings of fact, master's reports, and documents relating to appeals, such as bills of exceptions. There may also be supporting documents such as deeds, promissory notes, statements and inventories. Case files are arranged in docket order by court term. Until 1895 a case which continued over several court terms was assigned a different docket number for each term, but should be filed under the docket number assigned for the term in which the case ended. From the 1890s on, supreme court docket numbers are inconsistent because some cases were held in Lamoille County, and some heard or continued at the general term in Montpelier. Each court clerk assigned a different number, and the Lamoille clerk might record either number, or no number at all. There were only a few Lamoille county supreme court cases in any given term, so despite variable docket numbers case files can be found. Miscellaneous supreme court files include court administration documents such as financial accounts, supreme court bar admissions, and instructions to the court clerk. Chancery court case files predating June 1840 are included with supreme court case files, since chancery court was part of the supreme court during this period.
