Book excerpt: Case files include all documents generated during the course of a supreme court trial, and may be extensive, minimal or nonexistent for any given case. They may include writs, affidavits, depositions, subpoenas, verdicts, pleas, motions, warrants, bonds, bills of costs, witness certificates, transcripts, findings of fact, master's reports, and documents relating to appeals, such as bills of exceptions. There may also be supporting documents such as deeds, promissory notes, statements and inventories. Franklin County court clerks arranged case files alphabetically by plaintiff for each court term, rather than by docket number. This order has been maintained. Each case is filed with the court term in which it ended. In a given court term, some cases reached a judgment or verdict, while other cases were ended by the plaintiff before judgment. The clerk separated judgments from discontinued cases, so case files are arranged for each term with judgments in alphabetical order, followed by discontinuances in alphabetical order. Miscellaneous supreme court files include court administration documents such as financial accounts, supreme court bar admissions, and instructions to the court clerk. Chancery court case files predating September 1840, and some 1840-1843 cases, are included with supreme court case files, since chancery court was part of the supreme court during this period.
